Enchanted Potions Terms & Conditions
You agree that all information provided to Enchanted Potions is complete and accurate. You must be at least 18 years of age and legally capable of entering into a contractual agreement. As an Enchanted Potions Distributor you are not an employee, franchise holder, or legal representative for Enchanted Potions. You understand that you shall be working as a self-employed, independent contractor. You will be responsible for collecting/filing sales tax and filing all necessary federal, state and local taxes as may be applicable to any earnings, bonuses and prizes received from Enchanted Potions. You also understand that Enchanted Potions and its officers will in no way be held responsible for your failure to do so. In particular, you will not be treated as an employee with respect to any services for federal and state purposes. Also, any state unemployment or worker's compensation act does not cover you. As an Independent Enchanted Potions Distributor, you agree to represent Enchanted Potions in a truthful, sincere, honest and business-like manner, and to conduct yourself in a manner that will reflect the highest standards of integrity and responsibility in keeping with the reputation of Enchanted Potions. You also understand that failure to do so will be cause for immediate dismissal as a distributor and all ordering and product usage rights to be revoked. After expiration or termination of this agreement, you agree to respect the confidentiality of Enchanted Potions patents, trademarks, and trade secrets and to not disclose them to anyone. You agree not to make use of research done in the course of work done for Enchanted Potions while employed by any competitor of Enchanted Potions. You agree not to set up in business as a direct competitor of Enchanted Potions for a period of one year following the expiration or termination of this agreement. You understand that you will be held liable for damages if any violation of this paragraph is proved or admitted. This agreement incorporates by reference "Enchanted Potions Independent Distributor Policy" and any updates thereto. You understand that any violation of the terms of this agreement or any false information that you provide may result in immediate cancellation of this agreement and termination of your status as an independent distributor at the sole discretion of Enchanted Potions and authorized agents. You are aware that you must allow for at least 3 weeks for all orders to be processed and shipped. Allowing this timeframe for orders to be processed ensures that only the freshest and most fragrant high quality products are being sold. You understand that you must place a minimum $10 retail order upon submission of this application and at least once every 90 days thereafter. Failure to do so will result in termination of this agreement and your distributorship with Enchanted Potions. By signing this agreement you understand that this agreement will be governed by the laws of the State of Tennessee and shall become binding once approved by Enchanted Potions. Should you decide to forfeit distributorship at any time, you will not receive a refund of any payments made for startup kits or products purchased. You will also forfeit any accrued "Potion Points", commissions or awards not yet awarded to you. You agree to supply Enchanted Potions with a completed W-9 form for reasons that the company will issue a 1099 for any incentives or bonuses you receive and you agree to pay the applicable taxes on those monies. You understand that you will need to apply and receive a retail sales tax license in your own state to resell items. You agree that you will make the necessary arrangements to obtain the information for tax and business purposes through your own state. You understand that it is your duty to research this and not the obligation of the company because you are independently representing Enchanted Potions and not an agent of this company. Your also understand that when obtaining your licenses you will refer to yourself under a D.B.A. or your legal name and not as Enchanted Potions. Both the Independent Distributor and Enchanted Potions have the right to terminate this agreement at any time for any reason. You may only choose one sponsor and he/she cannot be changed. If you do not have a sponsor, one will be assigned for you. By typing your name on the application, you agree that your electronic signature is as legally binding as your actual signature.
